Up a creek? Couple asks court for changes to old-age home
An appearance by Mickey Rooney is scheduled for the upcoming open house at Aegis of Shoreline, and tours of the nearly built, full-service retirement home will highlight its many amenities.
What likely won't be mentioned is that next month a King County judge could order Aegis Assisted Living to tear down creekside portions of the facility.
Yesterday, attorneys for Aegis and the city of Shoreline sparred with lawyers representing neighbors of the development over its environmental impact.
Tim and Patty Crawford claim the 156-resident home is illegal -- built too close to salmon-bearing streams. Aegis officials and lawyers challenge whether the fish are using the streams and say the project improves the landscape.
The facility sits on a triangular swath that abuts Interstate 5. Thornton Creek flows through the site, slowing in the middle to become a pond that divides it into northern and southern parcels.
South of the site, the creek dives under I-5, reappearing in the Jackson Park golf course, where Seattle Public Utilities is restoring the creek for about $7.5 million.
The Crawfords and Aegis have been battling in court since 2000. The case has bounced between the Shoreline hearing examiner and King County Superior Court, where the case was heard yesterday.
Construction stopped for a time on the northern section of the nursing home, but resumed this summer.
The Crawfords' attorney told Superior Court Judge John Erlick they wanted the project scaled back in size to remove buildings within buffer zones near creeks. They say the city violated its development code by permitting construction. Erlick scheduled his decision for March 6.
