Boys in BB gun attack get time in wheelchair

AUBURN -- Two boys who fired their BB guns at a teenager in a wheelchair and several other children attending a church day care program will have to spend two days in wheelchairs themselves -- and then write a report on what it feels like.

The 12-year-olds, who were found guilty of seven counts of third-degree assault and one count of malicious mischief for their October spree at Luv-N-Care, could have faced up to 90 days' detention, plus 450 hours of community service if found guilty at a trial.

Instead, they received a deferred prosecution from King County Superior Court Judge LeRoy McCullough, who ruled Wednesday that the two complete 76 hours of community service in addition to the wheelchair time and a year on probation.

If the conditions are met, their records will be wiped clean.

Though none of the targets was seriously hurt, prosecutor Terry Carlstrom and the parents of two of the children, who also appeared in court, strongly objected to the deferred prosecution, said a spokesman for the King County Prosecutor's Office.

"There were a number of vulnerable victims who were placed in danger and could have suffered serious injury," spokesman Dan Donohoe said. "We would have been more inclined to a standard sentence that could have involved some confinement."

Now, however, the two boys will have to abide by a curfew, refrain from using any slingshots, knives, BB guns or other weapons, and sit in a mall pondering life in a wheelchair. Each must write a report on what he learned -- two-pages, typed and double-spaced -- by Dec. 15.
