Family of lawyer shot by rival not hopeful of recovery

BELLEVUE -- Doctors yesterday upgraded the condition of Kevin Jung, a lawyer who police say was shot in the head by a rival attorney, though his chances for recovery appeared slim.

Doctors at Overlake Medical Center "have been vague about his chances for recovery, largely due to the extensive brain injury incurred," Jung's family said in a news release. "It is highly unlikely he will be able to return to the type of life he has led in the past. ... It is simply too soon to tell what lies ahead."

A hospital spokesman said yesterday that Jung's condition had been upgraded to serious from critical.

Jung, a 44-year-old married father of two, was shot as he sat in his car in the parking lot outside his office Nov. 3. A witness provided police the shooter's license plate number, which was tracked to William R. Joice, a 50-year-old former Snohomish County deputy prosecutor.

Joice and Jung had been representing opposing sides in a contract dispute in Snohomish County Superior Court. The case file shows that Jung had become increasingly frustrated with Joice's failure to provide documents or comply with court orders. The morning of the shooting, a hearing was scheduled on Jung's motion to have Joice found in contempt.

Joice, charged with attempted first-degree murder, was scheduled to be arraigned Thursday in King County Superior Court. He was being held on $5 million bail.

Jung's family -- wife Sally and sons Bryan and Brendan -- thanked the local Korean-American community and Jung's fellow attorneys for their support. They also said they set up a fund on Jung's behalf at US Bank.

"It is exactly this type of violence that Kevin so diligently advocated against, and is why all who know him well are at a total loss as to why he was targeted," the statement said. "It is his family's hope that Kevin's ideals and unselfishness will be equally remembered."
