Four tribes will appeal Kennewick Man ruling

PORTLAND -- Four Northwest Indian tribes have filed notice that they will appeal the ruling of a federal judge who rejected their request to rebury the ancient skeleton called Kennewick Man.

Rob Smith, an attorney for the Nez Perce tribe, said yesterday that the Umatilla, Yakama and Colville tribes will join in an appeal to the 9th U.S. Circuit Court of Appeals. The filing was expected.

In August, U.S. Magistrate John Jelderks overturned a decision by then-Interior Secretary Bruce Babbitt to return the 9,000-year-old bones to the tribes for reburial.

The tribes claim the skeleton, found in 1996 along the banks of the Columbia River in Kennewick, is likely one of their ancient ancestors.

But a group of eight scientists went to federal court to challenge Babbitt, arguing there was no direct link between the tribes and the skeleton.

They said it offered a rare chance for researchers to look for clues about early migration to North America.

Jelderks agreed with the scientists.
